Terms & Conditions

This web site is operated by Fine Italy ("we", "us" or "our"). All purchases made on this web site are governed by these Terms and Conditions at any time although the Terms and Conditions governing any given purchase will be those in effect at the date of your order. If you order goods after we have published the changes you will be bound by those changes. Accordingly, you should check prior to each order to ensure that you understand the precise terms and conditions applicable to your purchase. To assist you in determining whether the Terms and Conditions have changed since your most recent order we will display the date when these Terms and Conditions were most recently updated.

 

Orders

Once you place an order online, it is classed as an offer.  By proceeding through the ‘checkout process’ and ticking the ‘Accept’ tick-box regarding these Terms and Conditions, you agree to these Terms and Conditions, and you are making an offer to purchase goods which, if accepted by Fine Italy, will result in a binding contract.

Your completion of the checkout process does not, however, constitute Fine Italy’s acceptance of your order. We will confirm acceptance of your order. This will occur either by message on the website immediately after you have confirmed your order, or by us sending an e-mail to the email address you have provided to us. We may do both, in which case the acceptance will occur on whichever arrives sooner of the web message and the email. At this point the purchase contract will be made and we will supply the goods to you in accordance with your order and these Terms and Conditions. Acceptance of your order and the formation of a contract between you and Fine Italy will take place unless Fine Italy has notified you that they do not accept your order, or you have cancelled it (please refer to Returns and Refunds).

 

Payments

Payments will only be accepted through the online payment system provided. 

Payment will be taken from your debit/credit card and an acknowledgment of receipt of your order will be emailed to you.  

Whilst your debit/credit card will, therefore, be debited before the contract is formed, if your order is ultimately rejected, a full refund will be made immediately.

If for some reason you do not receive an email acknowledging receipt of your order, yet your credit/debit card has been debited, please notify Fine Italy without delay.

 

Credit Card Security

Shopping online is very secure nowadays. At Fine Italy, we go way over and above standard security requirements to ensure that your credit card details can never be mis-used.

We never store credit card details. Instead, payments are taken entirely by our payment providers. During the checkout process, you will be transferred to their site where you enter your card details. The payment provider you have chosen (beneath our list) stores these details securely.

This is the most secure way of processing credit card transactions, as it means that your credit card details are taken directly by the payment provider, and never seen or stored by the merchant.

3D-Secure (Mastercard SecureCode and Verified By Visa)

Nowadays, almost all credit cards must be protected by the 3D-Secure system. After entering your credit card details, your credit card provider (Mastercard/Maestro or Visa) will transfer you to a screen where you will be asked to verify further details. This usually takes the form of a further password.

3D-Secure is becoming more commonplace nowadays, and though it seems like a nuisance, it does help to protect your credit card from unauthorised use.

 

Prices

All prices are in UK Pounds and are inclusive of VAT where applicable, at the current rate. The price of the goods will be as quoted on the web site at the time you confirm your order (usually by clicking the "checkout" button) subject only to any inadvertent technical error for which we will not be liable. If you subsequently amend your order, the prices charged will be those applicable to the amended item(s) at the time that the amended order is confirmed. Please note that as promotions are offered for a limited period of time subsequent amendments to your order may mean that certain promotions are no longer being offered.

 

VAT & Duty

Where applicable, these are charged at the current rate (January 2016). We reserve the right to change prices subject to a change in the rate of duty & VAT. Some goods contain zero rated VAT; on these items VAT is charged on the due amount only.

 

Delivery

Goods will be delivered free of charge in UK Mainland, by express courier, directly from our warehouse in Italy, within one working day for orders accepted and confirmed by noon. 

Please ensure that you input a full and correct delivery address (with postcode). We are unable to refund orders that are lost in the post due to mislabelling. We also are unable to cover the redelivery costs of such orders. Fine Italy accepts no responsibility if you enter an insufficient delivery address. Nor will we refund the postage cost of sending an order out to an insufficient or incorrect address. So please check your details fully before submitting an order. 

If the courier tries to deliver a parcel and you are out, they normally leave a "while you were out" card. However, in a small number of cases, this seems not to happen. In such cases, we will do our best to assist you. Note that during strikes we cannot guarantee any delivery times at all. 

 

Warranty and Liability:

Fine Italy shall not be liable for any loss which might occur after the parcel has been signed for on delivery. Our liability, in any circumstance and whatsoever the consequences, relating to any parcel ordered is limited to the invoice value of the parcel itself.

In addition that outlined above we will not be deemed to be in breach of contract or of these Terms and Conditions as a result of any delay in our performance or failure to perform our obligations if that delay or failure to perform is due to any cause or circumstance beyond our reasonable control including, but not limited to, fire, flood and other acts of God, strikes, riot, accident, disruption to energy supplies, civil commotion, acts of terrorism or war.

 

Order Cancellation

If you decide to cancel your order (or part of your order) before it has been dispatched, a cancellation/admin fee will be charged. This will be 10% of the existing order total.

According to EU Distance Selling Directive (97.7) we regret that we cannot accept withdrawal of contracts for the purchase of our products, once they have been dispatched, as they are “foodstuff”.

 

Order amendments

Amendments will only be possible depending on the situation. If you contact us before your parcel is dispatched you can add or swap items only if:

So please understand that we have to handle these requests on a case-by-case basis.

 

Refunds and Returns

If an item is damaged or defective, then we will either refund you for the value of the item, or send you a replacement at no extra cost. Please inform us immediately (within 24 hours) if your purchase has been damaged in transit, we will liaise with you directly about return postage or collection. 

Please retain all faulty items to return to us. Without evidence we cannot issue refunds or send a replacement. If an item cannot be kept for health and safety reasons please take photographic proof of the damage so that we can view the damage.

 

Gift Vouchers

Vouchers can only be used towards one transaction.

Vouchers can only be used towards to the value of goods, any delivery charges incurred are payable at checkout.
Vouchers cannot be part exchanged for cash. No change given on Vouchers not used to their full value.
Vouchers have a 12 months validity period.

 

Account

It is your responsibility to choose a suitably strong password and personal username to prevent unauthorised access to your account.  Please keep these confidential and secure.  All activity that takes place through your account is your responsibility.  If you believe that your username or password has become known to, or is being used by people other than you, please inform us immediately.

Personal and credit/debit card details supplied by you must be correct and valid and such that you are authorised to use.

 

Cookies

We use "cookie" technology to enhance and facilitate your visit at our website. The "cookie" files are sent to your computer, identify you as a unique user, and store your personal preferences and technical information.

We use:

a) Permanent "cookies" (i.e., the cookies remain on your computer until you delete them), and

b) Temporary "cookies" (i.e., the cookies last until you close your browser).

"Cookies" do not themselves contain or reveal any personal information. If you submit personal information via our website, information can be linked to the data stored in the cookies.

If you do not accept our use of cookies you may change your browser settings so that the browser does not accept cookies (instructions on how to change your browser's cookie settings should be found in the help section in your web browser). If you change the settings you will not be able to access certain parts of our website.
